The YourMD Provider Referral Program is designed to facilitate patient access to physician-led telehealth services delivered by licensed Providers at United Medical Group. This program is structured in compliance with applicable federal and state laws, including the Federal Anti-Kickback Statute (42 U.S.C. § 1320a-7b), the Physician Self-Referral Law (Stark Law), and applicable state referral and fee-splitting regulations in Nevada, Washington, and Oregon.
No referring provider, pharmacy, clinic, or individual receives financial compensation, payment, or anything of value from YourMD Online, LLC, United Medical Group, or any affiliated entity in exchange for patient referrals to YourMD Telehealth.
Referral participation is entirely voluntary and does not create any obligation to refer, nor does the volume or value of referrals affect any aspect of the relationship between YourMD and the referring provider. No fee, commission, bonus, rebate, discount, gift, entertainment, or other remuneration of any kind is, has been, or will be paid in connection with patient referrals.
Any patient promotional discounts offered through this program are provided directly to the patient and are not contingent upon or attributable to any referring provider's compensation. A promotional discount applied to a patient's first subscription cycle is a patient benefit and is not a kickback to the referring party.
All clinical decisions — including whether to prescribe medication, which medication to prescribe, the dose, the duration, and whether to continue or discontinue treatment — are made independently by YourMD Providers based solely on their medical judgment and the individual patient's clinical needs. No referring party has any authority, influence, or veto over clinical decisions.
A referral to YourMD does not guarantee that a Provider will prescribe any medication. A Provider may decline to prescribe based on medical history, contraindications, or clinical judgment, with no further obligation to the patient or the referring party.
Referring providers, pharmacies, and other referral sources are not agents, employees, partners, or representatives of YourMD Online, LLC or United Medical Group. Participation in the Referral Program does not constitute a joint venture, partnership, employment relationship, or any other legal association beyond the non-compensated referral relationship described here.
YourMD Telehealth does not accept referrals where the referring provider has a financial interest in the outcome of the referral beyond the ordinary course of their clinical practice. Providers with a financial interest in YourMD, its affiliates, its compounding pharmacy partners, or any medication supplied through the program must disclose that interest before referring any patient and may be excluded from participation at YourMD's sole discretion.
By enrolling as a referring provider, you acknowledge and agree to the following:
If you were referred to YourMD by another healthcare provider, please know that your referring provider does not receive any payment or financial incentive for this referral. Your care at YourMD is completely independent — our physicians will evaluate your health needs and make treatment recommendations based solely on your individual medical situation. You are under no obligation to use YourMD's services, and your relationship with your referring provider is not affected by whether or not you choose to proceed with treatment through our platform.
You may at any time ask your Provider, or email privacy@yourmd.online, to confirm whether any payment has been made to your referring provider in connection with your care. The answer will always be no.
When a pharmacy partner refers a patient to YourMD for a prescribing consultation, no financial consideration is exchanged between YourMD and the pharmacy in connection with the referral itself. YourMD physicians independently determine whether to prescribe medication based on clinical evaluation. If a prescription is issued, the patient or YourMD (depending on the billing model) selects the dispensing pharmacy. Referral of a patient to YourMD does not guarantee that a prescription will be written, does not guarantee that any specific pharmacy will receive the prescription, and does not create any obligation for YourMD to direct prescriptions to the referring pharmacy.
With the patient's express written authorization, YourMD may share relevant clinical information (treatment plan, medication prescribed, lab results, and progress updates) with the referring provider for care coordination purposes. This sharing is:
Revocation of authorization does not affect the legality of disclosures made prior to revocation.
When you arrive at YourMD through a referral link or referral code, we record the referral source in our internal database for program management and analytics. This data is not shared with the referring party in a manner that identifies you unless you provide separate written consent for clinical coordination (see Section 9). Referral source tracking is used for the following purposes only:
YourMD reserves the right to terminate any referring provider or pharmacy partnership at any time, with or without cause, upon written notice. Grounds for termination include, without limitation: failure to comply with applicable law; misrepresentation of the referral relationship to patients; solicitation of kickbacks from any party; conduct inconsistent with the compliance principles of this program.
YourMD reserves the right to modify the terms of the Referral Program at any time. Material changes will be communicated to enrolled referring providers via the email address on file.
